Please read this End-User License Agreement carefully before downloading or using SnapTrim.

Interpretation and Definitions

Definitions

For the purposes of this End-User License Agreement:

  • Agreement means this End-User License Agreement.
  • Application means the software program provided by the Company, named SnapTrim, distributed through the Microsoft Store.
  • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Wayne Koorts.
  • Country refers to: New Zealand
  • Device means any Windows device that can access the Application.
  • Microsoft Store refers to Microsoft Corporation’s digital distribution platform for Windows applications.
  • You means the individual accessing or using the Application.

Acknowledgment

By downloading or using the Application through the Microsoft Store, You are agreeing to be bound by the terms and conditions of this Agreement. If You do not agree to the terms of this Agreement, do not download or use the Application.

The Application is licensed, not sold, to You by the Company for use strictly in accordance with the terms of this Agreement.

License

Scope of License

The Company grants You a revocable, non-exclusive, non-transferable, limited license to download, install and use the Application strictly in accordance with the terms of this Agreement.

You may install and use the Application on up to ten (10) Windows devices associated with your Microsoft account, as permitted by the Microsoft Store terms of service.

License Restrictions

You agree not to, and You will not permit others to:

  • License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Application
  • Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the Application
  • Remove, alter or obscure any proprietary notice of the Company

Purchase and Pricing

SnapTrim is available for a one-time purchase through the Microsoft Store.

Payment processing and licensing are handled by Microsoft Corporation. The Company does not directly process or store your payment information.

Refunds

Refund requests are subject to Microsoft Store’s refund policy. Generally, Microsoft allows refunds within 14 days of purchase for digital goods. To request a refund, please contact Microsoft Store support directly.

Your Video Files

Local Processing

All video processing occurs entirely on your Device. Your video files are:

  • Never uploaded to our servers
  • Never transmitted over the internet
  • Processed and stored only on your local Device

Your Responsibility

You are solely responsible for:

  • Backing up your video files before processing
  • Ensuring you have appropriate rights to modify any video files you process
  • The content of your video files

No Liability for File Issues

THE COMPANY IS NOT RESPONSIBLE FOR ANY LOSS, CORRUPTION, OR DAMAGE TO YOUR VIDEO FILES. You should maintain backup copies of important video files.

Intellectual Property

The Application, including all copyrights, patents, trademarks, trade secrets and other intellectual property rights are, and shall remain, the sole and exclusive property of the Company.

Third-Party Components

The Application may utilize third-party software libraries and components for video processing. These components are subject to their own licenses.

Privacy Policy

The Company collects, stores, maintains, and shares information about You in accordance with Our Privacy Policy: https://snaptrim.app/privacy-policy

Term and Termination

This Agreement shall remain in effect until terminated by You or the Company.

You may terminate this Agreement at any time by uninstalling the Application from all your Devices.

Disclaimer of Warranties

THE APPLICATION IS PROVIDED TO YOU “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND.

The Company provides no warranty that:

  • The Application will meet your requirements
  • The Application will operate without interruption or be error-free
  • Any errors or defects can or will be corrected
  • Your video files will not be corrupted or lost

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • The Company’s entire liability under this Agreement shall be limited to the amount You actually paid for the Application
  • The Company shall not be liable for any special, incidental, indirect, or consequential damages

Governing Law

The laws of New Zealand, excluding its conflicts of law rules, shall govern this Agreement and your use of the Application.

Changes to this Agreement

The Company reserves the right to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days’ notice.
